This document lays out the disclaimers that apply to the access and use of the marketfeed Platform through the Website https://www.marketfeed.com and the marketfeed mobile application (“Platform”). The words, "You" , “Your” and “User” refer to the person(s) who use the Platform and access the offerings available on the Platform. In terms of the Information Technology Act, 2000, this document is an electronic record. Being generated by a computer system, it does not require any physical or digital signatures. Your acceptance to the terms and conditions of use (“Terms") shall be considered as your consent to use the Platform in accordance with the Terms laid down by the Company.

1. Fundfolio Fintech Private Limited (“We”,“Us” or the “Company”) is a technology company registered under the Companies Act, 2013, that provides solutions for accessing research recommendations and reports issued by SEBI registered research analysts through the Platform


2. Such research reports may include periodic buy, sell, and hold recommendations issued by the research analyst pertaining to certain securities, under the nomenclature of 'strategies’, on the basis of various parameters, including the price of such securities and time frames. While research recommendations and reports on the Platform can be viewed or accessed at no cost on the Platform at present, We retain the right to introduce paid subscription plans for Users in the future


3. In order to facilitate the execution of the recommendations and reports issued on the Platform, We offer Users the facility to automate the placement of trades through API integration with empanelled stock brokers. The User has sole and complete discretion in deciding whether to utilize the trade automation facility and the presence of such feature on the Platform cannot be seen as a recommendation or solicitation by Us to opt for the same. It is hereby clarified that the Platform is not a trading terminal and trades will be executed in the User’s own broking account, through the empanelled stock broker(s) on its trading platform. You will be required to maintain an adequate balance with Your stock broker to execute a trade.


4. The uptime and accessibility of APIs may be affected by technical or other factors outside the Platform’s control or unforeseen circumstances. We do not make any promises, commitments or assurances about the API integration offered by stock brokers on our Platform. Please be aware that We will not be responsible for any losses, damages or liabilities, in any form and manner, arising out of the use of such APIs.


5. Users are responsible for their investment decisions and are responsible to validate all the information used to make the investment decisions. The appropriateness of a particular strategy or recommendations will depend on the User’s individual circumstances and risk appetite. The investment decisions of Users are based on their investment objectives and the information available on the Platform shall be seen in consideration of the Users’ investment objectives.


6. The value of any investment may rise and/or fall as a result of market changes and the Platform does not intend to predict the actual performance and/or success of any strategies and no assurances are given with respect thereto. Past performance does not guarantee future returns. Investments in the securities market are subject to market risks and the Users should read all the related documents carefully before investing


7. We advise the User to consult their financial advisors or other qualified professionals before making any investment decisions. The User agrees to assume complete and full responsibility for the outcomes of all their investment decisions, including but not limited to losses, if any, that may be incurred by them. We shall not be responsible or liable for any losses, damages or other liabilities arising out of the User’s investments in the securities markets


8. We may publish internally generated or externally sourced indicative summaries, updates, commentary, analysis and information related to various events, developments, concepts or principles on the Platform. Such content is provided only for informational and educational purposes and should not be construed as investment advice, tax advice, recommendation or solicitation to buy/ sell/ hold any securities, or an advertisement or endorsement or offer to sell any products of any third-party entities. All summaries, analysis and information are historical and for illustration purposes only and are subject to modification over time. The information available on the Platform will be updated from time to time. We reserve the right to rectify errors/discrepancies in the date and information provided on the Platform, if any are observed or brought to our notice, at any point in time, without being liable for such errors/discrepancies.


9. The Platform does not purport to disclose all risks and other significant issues relating to any investments. No representation is made as to the reasonableness of the assumptions made within or the accuracy or completeness of any data on past performances or historical analysis, and any other analysis of any of the research reports or recommendations published by SEBI registered research analysts on the Platform.


10. We do not warrant, endorse or assume responsibility for any information available on the Platform and We will not be a party to, or be responsible in any manner, for any transactions executed by the User on the basis of the research reports or recommendations issued by research analysts on the Platform. We are not responsible for any dispute arising between the User and research analysts. We do not have any control over such dealings and transactions, and play no determinative role in the performance in respect of the same. The User acknowledges that We shall not be responsible or liable for any direct, indirect, incidental, consequential, special, punitive or any other damages (including loss of profit, loss or corruption of data, work stoppage, system malfunction) arising out of the use of the Platform and/or use of information and content available on the Platform and/or investing in securities through the offerings available on the Platform.


11. We do not represent or guarantee whatsoever the authenticity, quality, accuracy, correctness, or completeness of any of the information and contents, and We do not assume any responsibility for the same. We specifically state that We cannot be held liable for any losses or damages (monetary, legal or otherwise) caused by any error, omission, interruption, deletion, or defect in the information available on the Platform, and/or resulting from investments in securities, made on the basis of any information provided on the Platform.


12. The percentage returns displayed on the Platform for each strategy are computed as absolute returns and do not incorporate any backtested data. Such figures are provided for informational purposes and should not be construed as a promise of risk-free, guaranteed or assured returns. Investing in the market involves inherent risks and Users should carefully consider their risk tolerance and financial circumstances before making investment decisions.


13. Data used for the calculation of percentage returns, and other information, may be obtained from exchange-approved third-party data vendors, which is not audited or validated by Us. We are not responsible for verifying the accuracy and correctness of information sourced from such vendors.


14. The Platform may contain material in the form of inputs submitted by Users and We accept no responsibility for the content or accuracy of such content. The Platform is provided on an ‘as is’ and ‘as available’ basis and We do not make any representations or warranties as to the operation of the same. The User agrees that their use of the Platform is at their own risk. We do not warrant that the contents of the Platform, its servers, emails, and other communication sent from the Platform are free from viruses or other harmful properties and shall not be liable for damages of any kind arising from the same. The Platform may not be compatible with the User’s device and/or operating system and We take no responsibility for the same. We do not guarantee that a User’s access to the Platform will be uninterrupted or error-free. The Platform may be unavailable from time to time due to required maintenance, telecommunications interruptions, technical errors/interruptions or other disruptions which hamper the continuous provision of services through the Platform and the functioning of the Platform.


15. Personal information of a user collected by Us will not be shared with any third-party, except for the cases specified in the ‘Terms’ and ‘Privacy Policy’.


16. We hereby expressly disclaim any implied warranties imputed by the laws of any jurisdiction. We consider ourselves and intend to be subject to the jurisdiction only of the courts of Bangalore in India.


17. The User’s use of the Platform and all information contained therein is governed by the ‘Terms’, ‘Privacy Policy’ and the terms of the above disclaimer, available on the Platform. If the User does not agree with any of the terms of the disclaimer, or with the ‘‘Terms’ or ‘Privacy Policy’, the User shall not access the Platform and immediately exit from the same. We reserve the right to make changes to the Platform and the terms of this disclaimer, or the ‘Terms’ and ‘Privacy Policy’, at any time.
